1. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) for the processing described below is:

No data protection officer has been appointed, as the conditions of Art. 37 GDPR and § 38 BDSG are not met.

2. Scope of this policy

This policy applies to this website and to the browser game HYPERGOL served from it. Personal data is any information relating to an identified or identifiable natural person (Art. 4 no. 1 GDPR).

If you play HYPERGOL embedded on a third-party game portal (see section 7), that portal operates its own website and is the controller for the processing that takes place there. Its own privacy policy applies to it in addition to this one.

3. Hosting and server log files

This website is hosted on Cloudflare Pages, a service of Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Cloudflare processes personal data on our behalf on the basis of a data processing agreement pursuant to Art. 28 GDPR, and also acts as a content delivery network and protection layer in front of this site.

When you access this website, information transmitted by your browser is automatically processed in what are known as server log files. This comprises:

1. the page or file requested and the time of the request;
2. the volume of data transferred and confirmation of successful retrieval;
3. the browser type and version, and the operating system used;
4. the referrer URL (the page previously visited);
5. the IP address of the requesting device.

This processing is necessary in order to deliver the website at all, and is carried out on the basis of our legitimate interest in the stable, secure and fault-free operation of this service and in defending against attacks (Art. 6 (1) (f) GDPR). This data is not merged with other data sources, and no attempt is made to identify you from it. It is stored only for as long as necessary for those purposes and is then deleted or anonymised.

4. TLS encryption

This website uses TLS encryption for security reasons and to protect the transmission of data. You can recognise an encrypted connection by the “https://” prefix in your browser's address bar.

5. Your save file and settings (local storage)

HYPERGOL stores your progress and your preferences in your own browser's local storage (localStorage), under the keys hypergol.profile (the save file: unlocks, equipment, records, campaign progress) and hypergol.settings (audio levels, video quality, accessibility and gameplay preferences, key bindings). Installations that predate the current version may also carry keys left over from earlier releases; these are migrated or discarded by the game itself.

This information stays on your device. It is not transmitted to us, is not stored on any server, and is not accessible to any third party. There is no account and no registration: we hold no player record of any kind, and progress made in one browser does not follow you to another.

Storing this data is strictly necessary in order to provide the game you have expressly requested — a game that cannot remember your progress or your settings is not the service being offered. Accordingly, no consent is required under § 25 (2) no. 2 TDDDG. Insofar as any of this constitutes personal data at all, the legal basis is Art. 6 (1) (f) GDPR, our legitimate interest in a functioning game.

You remain in control of it. In the game, open Settings → DATA: EXPORT hands you your save as a code, and ERASE SAVE deletes it from this device. You can also clear the entries at any time through your browser's settings, or prevent them from being written by using your browser's private browsing mode — the game will then simply start over on each visit.

6. Cookies, analytics and external resources

This service sets no cookies whatsoever. It uses no analytics, tracking, profiling or advertising technologies, and does not follow your behaviour across sites or sessions.

HYPERGOL is built without external assets: every graphic and every sound is generated by your own device as you play, and the typefaces used are those already installed on your system. No fonts, scripts, images, maps or media are loaded from third-party servers — in particular not from Google Fonts or any content delivery network other than the one serving this site. Consequently, your IP address is not disclosed to any such third party.

7. Game portals and advertising

HYPERGOL contains an integration layer for the advertising and analytics SDKs of the game portals Poki (Poki B.V., Amsterdam, Netherlands) and CrazyGames (CrazyGames BV, Leuven, Belgium), so that the game can be published on those platforms.

On this website that layer is switched off. No portal SDK is loaded, no request is made to a portal's servers, and no advertising is displayed. The integration becomes active only in the separate builds delivered to those portals; when you play the game there, the portal is the controller for the resulting processing (including any advertising identifiers and consent management) and its own privacy policy applies. For completeness: the game also accepts a diagnostic URL parameter (?ads=) used during development, which can load a portal SDK on request; it is not set in normal use and no such script is loaded unless it is supplied deliberately.

Should advertising ever be introduced on this website, the associated scripts would be loaded only after your consent under § 25 (1) TDDDG and Art. 6 (1) (a) GDPR, and this policy would be updated beforehand.

8. Contacting us

This website provides no contact form. If you contact us by e-mail, we process the data contained in your message — in any event your e-mail address, and any further details you choose to provide — solely in order to deal with your enquiry. The legal basis is Art. 6 (1) (f) GDPR, our legitimate interest in answering enquiries addressed to us, and, where your enquiry is directed at concluding or performing a contract, Art. 6 (1) (b) GDPR. We retain such correspondence until your enquiry has been dealt with conclusively and there is no reason to expect further communication; statutory retention obligations remain unaffected.

9. Recipients and transfers to third countries

Your data is disclosed to third parties only to the extent described in this policy, and only to processors we have selected with care and bound by contract in accordance with Art. 28 GDPR:

Insofar as personal data is thereby transferred to a third country outside the EU or EEA — in particular to Cloudflare in the United States — this takes place on the basis of the European Commission's Standard Contractual Clauses (Art. 46 (2) (c) GDPR) together with supplementary safeguards and, where applicable, on the basis of an adequacy decision (EU–US Data Privacy Framework).

10. Retention

We process and store personal data only for as long as is necessary to achieve the respective purpose, or for as long as statutory retention periods require (in particular under German commercial and tax law, § 257 HGB and § 147 AO). Once the purpose ceases to apply or those periods expire, the data is deleted. Data held in your browser's local storage is not subject to any retention period on our part: it remains on your device until you delete it.

11. Children

HYPERGOL requires no registration and collects no personal data from its players, whatever their age. In particular, we ask for no name, no e-mail address and no date of birth, and we build no player profiles.

12. Your rights

You have the following rights in relation to the controller:

1. the right of access to the personal data we process about you (Art. 15 GDPR);
2. the right to rectification of inaccurate data, or completion of incomplete data (Art. 16 GDPR);
3. the right to erasure (Art. 17 GDPR);
4. the right to restriction of processing (Art. 18 GDPR);
5. the right to data portability (Art. 20 GDPR);
6. the right to object to processing (Art. 21 GDPR);
7. the right to withdraw consent at any time with effect for the future (Art. 7 (3) GDPR).

Right to object: where we process data on the basis of our legitimate interests (Art. 6 (1) (f) GDPR), you have the right to object at any time on grounds relating to your particular situation.

An informal message to lattisfy@gmail.com is enough to exercise any of these rights. Please note that, because the game holds your save file only on your own device and we receive no identifier from you, we are generally unable to link server log entries to you as an individual; in such cases Art. 11 (2) GDPR applies.

13. Right to lodge a complaint

Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:

15. Language

This policy is provided in English, the language in which HYPERGOL is published. It is drafted under German and European data protection law; the German statutory provisions cited are referred to by their official German designations.
